Hessian AfD may be observed by the Office for the Protection of the Constitution

According to a ruling by the Wiesbaden Administrative Court, the Hessian state association of the AfD may be monitored by the State Office for the Protection of the Constitution as a so-called suspicious case. The court announced on Tuesday following its decision on the urgent application that there were "sufficient factual indications of efforts by the Hessian state association of the AfD that are directed against the free democratic basic order in the form of the guarantee of human dignity and the principle of democracy".

At the same time, the Administrative Court ruled that the State Office for the Protection of the Constitution (LfV) had unlawfully informed the public about the observation of the AfD in a press release. For this reason, the LfV is obliged to publish a new press release stating that it must refrain for the time being from announcing that the AfD is listed as an object of observation or as a suspected case. The decision (6 L 1166/22.WI) is not yet legally binding.

The monitoring of the Hessian AfD as a suspected case by the Office for the Protection of the Constitution raises questions about the Party's commitment to upholding the principles of justice and democracy. Despite the court's ruling against the LfV's public announcement of AfD's observation, the protection of the constitution remains a crucial aspect in ensuring the stability of the democratic order.
