A man who was sentenced to 9 years in prison for attempted murder at the Ulm District Court needs his case to be re-examined. This was announced by the Federal Court of Justice (BGH) in November. The sentence was criticized for both its motivation and the punishment given. However, no one disputes the actual sequence of events. The Ulm District Court will have to handle the case again. The man was found guilty of attempted murder, attempted arson causing a fatality and inflicting bodily harm.

The BGH took issue with how the court handled the question of the defendant’s low intentions. The conviction for attempted murder was not upheld in the legal review, according to the court's reasoning in the decision.

The Ulm District Court believed there was enough evidence to show that the German man set fire to his ex-wife's car, as well as her new partner's car in April 2023 and then to their house where his ex-wife, their son, her new partner, and his son were staying. The defendant claimed he didn't want to hurt anyone.

"It's the sorrowful end of a relationship," the judge said during the sentencing. The cars, in which the defendant had invested money and effort, were linked to the split. Given his intoxication, the defendant did not want his wife to live there. He doused the vehicles in gasoline and ignited them. He then shattered a window in the house and covered it in gasoline. He took it for granted that the occupants would die. In a struggle, in which both were injured, the partner seized a lighter from the defendant. In response to his arrest, the defendant violently resisted, stabbing a police officer with a shard.
