Nuremberg Regional Court - Fraud: Operator of care service sentenced
The regional court in Nuremberg has sentenced the operator of an outpatient care service to 5 years and 9 months in prison for defrauding care and health insurance companies of several million euros. The co-defendant's wife was acquitted. The couple's son was sentenced to a suspended sentence of one and a half years for aiding and abetting fraud. Both were released from custody during the trial.
An anonymous tip-off to the public prosecutor responsible for healthcare fraud in Nuremberg had triggered the investigation. They charged the couple and their son with more than 1,000 cases. Between 2018 and 2022, they are alleged to have illegally billed for services, thereby pocketing almost 3.5 million euros.
The chamber now considered the 57-year-old man to have been proven guilty of fraud in 700 cases, as a court spokeswoman said on Wednesday. The amount of damages is around 3.3 million euros. The woman's role was classified as subordinate; she is not considered an accomplice.
The men's defense lawyers had pleaded for acquittal, while the general public prosecutor's office pleaded for six years in prison for the father and a suspended sentence for the son.
In the opinion of the chamber, the fraud had come about because the men billed for services without being able to produce a nursing service manager. However, such a specialist is necessary in order to receive any money from the insurance companies.
Whether the patients cared for by the nursing service in the Würzburg and Kitzingen area suffered any harm was not the subject of the proceedings. The police have completed their investigation into possible care deficiencies. The public prosecutor's office in Würzburg is now investigating the allegations.
