A bank manager convicted of embezzlement was given a suspended prison sentence and ordered to repay the stolen funds. However, he challenged some aspects of the decision in the German Federal Court of Justice.

In the instance of ex-bank chief Enrico Kahl, who was convicted in Münster, the Landgericht has to reassess one thing. The Bundesgerichtshof (BGH) in Karlsruhe gave the green light to his appeal on March 12, 2024, as disclosed on Wednesday in Karlsruhe.

The previous manager and chief of the Sparda-Bank in Münster copped a probationary sentence of two years for misappropriation in 141 instances. The court also mandated performing 300 hours of community work and seizing roughly 200,000 euros as reparation.

Kahl appealed the payment of this sum. The BGH confirms his argument was valid. Another division of the Landgericht needs to revisit this matter. The judges in Karlsruhe spotted legal flaws in their evaluation of this aspect. This pertains to the query of how management liability insurance payment impacts the circumstances.

The Sparda-Bank Münster was a cooperative bank, whose clients inherently were railway employees. In 2018, it fused with the Sparda-Bank West in Düsseldorf.
