Hamburg District Court - Fatal stabbing in shisha bar: revision
The public prosecutor's office has lodged an appeal against a verdict by the Hamburg district court for manslaughter in a shisha bar. The case will now be dealt with by the Federal Court of Justice in Karlsruhe, a spokeswoman for the public prosecutor's office said on Friday. It will take "at least two months, if not longer" before a decision is made.
A 49-year-old man had been sentenced to eight years in prison in the case a week earlier. The chamber considered it proven that the man had returned to the building on the morning of March 26, 2023 after an initially ended argument in a shisha bar, grabbed at least one knife from the bar area and stabbed his opponent four times with it. Despite resuscitation efforts, the 35-year-old died a short time later in hospital. Two days after the incident in the Hammerbrook district, the Montenegrin national handed himself in to the police.
The chamber used a reduced sentence as a basis, as the defendant's ability to control his actions had been significantly impaired by alcohol and cocaine consumption at the time of the offense, said presiding judge Nora Karsten when explaining the verdict. The public prosecutor had previously demanded 13 years in prison.
After the verdict was read out, unrest broke out in the auditorium, where members of the victim's family were among those watching the hearing. Several people banged on the window to the courtroom, insulted and threatened the defendant. There was also verbal abuse within the group of spectators. The session had to be interrupted.
