Falsified Language Tests: Fraudsters Facing Legal Action

To acquire a German passport, non-nationals must provide a language proficiency certification. This allegedly infallible method, however, may not always be true, as instances reveal. A court case underscores this.

To acquire a German passport, non-citizens must clear the naturalization and language exams. These hurdles present different levels of difficulty, making it tempting for some to take a shortcut - resorting to cheating. The Stuttgart Regional Court will handle various similar cases in the upcoming weeks. Here, two suspects aged 37 and 31, are on trial, accused of producing fake documents such as language certificates and certificates from the Federal Office for Migration and Refugees. They are alleged to have distributed these counterfeits in a local Backnang center or through a language school in Ellwangen. Out of these 561 cases, 221 of the recipients used these forged documents to gain citizenship or permission to live in Germany.

The brothers are also charged with illicitly smuggling in foreigners. The prosecution claims they earned approximately 880,000 euros through this illicit business. Future leads regarding other potential accomplices will be examined separately, the prosecution stated.

While infrequent, cases of fraud have occurred where foreigners with good German linguistic capabilities are sent to take the naturalization language examinations. Multiple language schools have made headlines due to reports of assisting immigrants in cheating on these language tests or even turning a blind eye.

Since 2008, any immigrant wishing to obtain a German passport must pass a language test. This regulation is in place to demonstrate proficiency in the German language. The German government expects immigrants seeking naturalization to be fluent in the language to the point they can communicate effectively with their fellow citizens, in their workplaces, and with German authorities.

In Baden-Württemberg, as per the State Statistics Office, 22,745 foreigners were granted German citizenship in the previous year, showing an 8.5% increase compared to the preceding year. This is the highest number of naturalizations since 2002. Syrians topped the list of recipients, while naturalizations from Iraqi and Afghan nationals increased notably compared to prior years. This is largely due to the high influx of immigrants from these countries in recent times.
