The election overseer will scrutinize the outcome of the district assignment within the Saxon legislative assembly. Various political parties and election experts from Wahlrecht.de suspect that the state election overseer may have committed an error in the latest district assignment within the legislative assembly, as reported by the "Leipziger Volkszeitung". It appears that an incorrect district assignment process was employed. The spokesperson for the state election commission acknowledged this to dpa.

As per LVZ, under the alternative process, the AfD would have missed out on one seat, thereby losing their veto power in the legislative assembly. This veto power allowed the AfD parliamentarians to hinder the passing of certain state laws that necessitate a two-thirds majority of all members.

In Saxony, as in other federal states, constitutional judges and the heads of the state audit offices are elected with a two-thirds majority of all parliamentarians. Consequently, certain roles could not be filled sans the AfD's approval. Furthermore, the legislative assemblies could not self-dissolve.

Following the provisional results, the CDU emerged as the predominant force once more with 31.9% of the votes. The AfD came in second with 30.6%, while the "Sahra Wagenknecht" (BSW) alliance managed to secure 11.8% of the votes from scratch and is expected to play a significant role in future government formation. The SPD garnered 7.3% of the votes, with the Greens settling at 5.1%. The Left barely made it into the legislative assembly with 4.5%, thanks to winning two direct mandates in Leipzig. A clause then applied that enabled them to enter the legislative assembly based on their second vote results, despite falling below the 5% threshold.

The error in the district assignment, which could have resulted in the AfD losing a seat and their veto power in the Saxon legislative assembly, has been a topic of controversy among various parties and election experts. If the alternative district assignment process had been employed, as reported by LVZ, the AfD would have been impacted significantly in the legislative assembly.
