Rostock - Eight years in prison for ex-nursing home manager: "Highly criminal"
The Rostock Regional Court has sentenced a former nursing home operator to eight years in prison for defrauding health insurance companies of millions. On Monday, the criminal court included a four-year prison sentence that the 37-year-old has been serving since May of this year. According to the verdict, five months will be counted as served due to the excessive length of the proceedings. The defendant is guilty of commercial fraud in 76 cases, according to Judge Peter Goebels.
The allegations involved more than 1,000 invoices and a period of around two and a half years between spring 2013 and autumn 2015. The defendant ran a care facility in Krakow am See (Rostock district). However, in order to bill the services to the health insurance company, including AOK Nord, the legally required position of nursing service manager was missing. Despite this and in the knowledge of this, the defendant submitted invoices. The judge ordered a sum of around 1.3 million euros to be collected.
The accused bought jewelry and clothes through the account of her care service, hotels also paid themselves wages, fuel money, a bonus of 15,000 euros and a bonus of 100,000 euros. Her partner at the time also benefited from rents of up to 12,000 euros paid to him. From May 2013 to the end of 2015, the money allocated to her and her partner accounted for over a quarter of the care service's total expenditure.
The judge was particularly critical of the fact that the defence lawyer and the defendant submitted receipts retrospectively, which turned out to be forged. "We will not be fooled by you. You can do nothing but falsify," said Goebels. He accused the defendant of being highly criminal. "When in doubt, you walk over dead bodies. They don't care."
He also referred to a previous verdict from 2022, according to which patients had been severely neglected in the defendant's care facility. There was "no remorse, no insight, zero, nothing" on the part of the defendant. With its verdict, the court fell short of the prosecution's demand for a total prison sentence of ten years. The defense lawyer had pleaded for acquittal. The verdict is not yet final.
In June 2022, the Rostock Regional Court sentenced the woman to four years' imprisonment for deprivation of liberty, ill-treatment of protected persons and fraud. The sentence became final at the beginning of this year. According to the district court, senior citizens were housed in the facility, which was closed in 2016, in inhumane conditions for profit.
