Duration of asylum proceedings slightly reduced in Saxony

The processing time for asylum court proceedings is to be significantly reduced - to three months according to the minister presidents. In Saxony, it is currently more than 16 months.

Duration of asylum proceedings slightly reduced in Saxony

In future, legal proceedings in asylum matters should not take longer than three months for asylum seekers from certain countries. In Saxony, the main proceedings currently take an average of 16.7 months, as the Ministry of Justice informed the German Press Agency on request. The duration has decreased in recent years. In 2021, it was still 18.6 months on average and 18.3 months in 2022. Expedited proceedings are also being completed more quickly in Bavaria. Two years ago, they still took 1.3 months, whereas now they take one month.

At the same time, the number of appeals in asylum matters at Saxony's administrative courts is on the rise again. According to the Higher Administrative Court (OVG) in Bautzen, 5205 cases were filed with the asylum chambers in 2022. The statistics show 4020 asylum applications and 1185 applications for interim legal protection - so-called summary proceedings. Compared to the previous year, almost 560 more asylum applications were received, which corresponds to an increase of around 14 percent.

At their meeting on 13 October, the minister presidents of the federal states formulated the goal of concluding asylum procedures for people from countries for which the recognition rate is less than five percent more quickly than before. At the same time, they announced that they would create the personnel and organizational prerequisites for this if they did not already exist. The aim is to complete the asylum and subsequent court proceedings within three months, according to the resolution.

In the pursuit of this goal, implementing expedited procedures for asylum seekers from countries with low recognition rates could contribute to promoting justice in migration matters. However, the increased number of appeals in asylum matters at Saxony's administrative courts may present challenges in achieving this three-month target.
