Death threats: Father and brother go to prison

Augsburg Regional Court - Death threats: Father and brother go to prison

A girl was the victim, the perpetrators were her own father and older brother. In view of this drama, the presiding judge Claudia Kögel found clear words in her judgment on Thursday: "There is no other way to describe this than martyrdom", she said of the daughter's suffering.

The two men were again sentenced to prison in Augsburg after numerous chastisements and threats against the youngsters. The 45-year-old father was sentenced to three and a half years in prison for dangerous bodily harm, threats and other offenses, while the 24-year-old brother received three years. A similar sentence had already been handed down at first instance at the district court.

Among other things, the two defendants had held a family tribunal in which the killing of the girl was discussed in her presence - she had to cower in the corner. In addition, the child had to write a farewell letter to make such an act look like suicide.

The girl, who is now 17 years old, was able to flee to the youth welfare office and is now being hidden from her family in a secret location. The reason for the death threats issued in spring 2022 was that the girl had a boyfriend with whom the Yazidi family did not agree. Yazidis only tolerate partnerships within the group.

In his plea, the father's defence lawyer tried to relativize the gruesome events. The act of violence had only been talked about. It was never about actually killing the girl. "That would never have happened," he said.

The judge said that it was not possible to examine how serious it was at the time. However, she did not think it was trivialized, the girl had certainly been in "intense fear of death". She accused the father of having completely failed in his parental duty of care. He should have protected his daughter, but: "You were the danger and the threat to your child!"

Kögel emphasized that the daughter would suffer for the rest of her life. She had had to give up her entire family and circle of friends for her new, anonymous life. She was a "tough, brave girl" who had sought help in good time, said the judge.

At first instance, the men were each sentenced to three years and eight months in prison at the local court. Their appeal in the new proceedings was ultimately limited to the sentence. The judge had previously made it clear that she saw no chance at all of a suspended sentence - but did see a chance of an even harsher sentence. In the end, the abused teenager was spared having to testify again in court.

Only the brother had shown recognizable remorse in the new proceedings. He apologized several times to his "little sister", who was not present, and also wrote her a three-page letter. He has also already paid her 1000 euros in compensation for pain and suffering and wants to transfer another 14,000 euros in installments after her imprisonment. The father made no such binding promise, he only apologized very briefly - very shortly before the new verdict.

The two defendants were born in Iraq, where many Yazidis live. The father is an Iraqi citizen. His co-defendant eldest son also has German citizenship. The two men have been in custody for some time. Theoretically, they can now appeal against the verdict again. However, the father emphasized at the very end that he does not intend to do so: "That's enough," he said (case no. 2NBs 407 Js 116539/22).
