Court revokes new construction permit for Kampenwand cable car

The approval for the construction of the new Kampenwand cable car in 2022 has been revoked by the Administrative Court in Munich. According to the ruling from November 16, which was published on Wednesday, the decision by the Rosenheim district office was vague and therefore unlawful.

It was not clear where trees were to be felled and to what extent. The decision, which is not yet legally binding, states that it cannot be ruled out that trees would have to be felled in the natural forest, which would be inadmissible.

At the end of October, the chamber traveled to Aschau in Chiemgau to see the location for itself. The cable car to the 1669-metre-high, popular excursion mountain above Chiemgau was built in the 1950s. According to the operators, they wanted to "renovate it moderately" and adapt the gondolas and stations, including the technology, to today's expectations. A permit for this has been in place since 2017. According to the operators, the route was to remain unchanged, although individual trees would have to be felled in order to set up a transport system for the construction material.

An amendment notice issued by the Rosenheim district office in June 2022 caused trouble, but the court deemed this to be a new permit. This was also the view of the Bavarian Nature Conservation Association (BN), which also criticized planned capacity expansions and night-time driving in the already heavily used area. This could cause the population of the black grouse, which is threatened with extinction, to collapse. However, the chamber rejected corresponding requests for evidence. According to the reasoning, this was not the point of the decision.

The revocation of the permit for the cable car project has led to questions about the future of tourism-related processes in Kampenwand. Municipalities in the Chiemgau region may need to reconsider their leisure time policies, taking into account the implications of this decision for popular excursion mountains.
