Processes - Court excludes Bushido's ex-manager from apartment deal
Approximately two dozen apartments, collectively worth millions: After a lengthy dispute, Bushido's former business partner was excluded from the real estate business with the rapper by the Oberlandesgericht (OLG) in Brandenburg an der Havel. However, he is expected to receive a compensation of around one million Euro, according to a spokesperson of the OLG in Brandenburg an der Havel on Wednesday. The court found that Ex-Manager Arafat Abou-Chaker had withdrawn a total of approximately 180,000 Euro from the company assets for his own use. This was a reason for the exclusion, stated the presiding judge on Wednesday. A revision was not allowed.
In the civil lawsuit, it was about 80 apartments in the Brandenburg district of Rüdersdorf (Landkreis Märkisch-Oderland), which both purchased together several years ago. The apartments are currently estimated to be worth approximately seven million Euros according to the court. Neither the rapper nor Abou-Chaker were present at the judgment on Wednesday. The lawyers were also absent from the courtroom.
The essential part of the process was the withdrawal of the 180,000 Euro as a reason for exclusion against the Ex-Manager. Abou-Chaker countered that Bushido had approved the withdrawal himself. His brother, who had withdrawn the money from the bank, testified in court that Bushido knew about the withdrawal. The court did not believe this version of the story.
Bushido, with the civilian name Anis Mohamed Ferchichi, had stated in the trial weeks ago that Abou-Chaker's brother had withdrawn the 180,000 Euro from the company assets without his knowledge. The rapper could describe the circumstances surrounding the mentioned sum in detail and convincingly, said the judge of the OLG on Wednesday. Therefore, the chamber believed his account.
For years, Bushido and Arafat Abou-Chaker, who is known as the Berlin Clan boss, have been disputing in court. For a long time, they were close friends. Abou-Chaker was the best man at Bushido's wedding. They bought a plot of land together in Berlin to live with their families. They were also often seen together at public events. After the break-up of their formerly close friendship in 2017, there were allegations from Bushido that Abou-Chaker had become violent. These occupied the Berlin justice system for a long time. The Landgericht Berlin spoke of a not guilty verdict for the Ex-Manager in the essential points after a nearly three-and-a-half-year trial. The public prosecutor appealed the decision.
The findings in this case were of minor significance for the civil lawsuit about the apartments, explained the presiding judge of the OLG on Wednesday. "The exclusion of the company had only marginal relevance to the criminal proceedings in Berlin," he said. The essential matter was the 180,000 Euro.
The lawyers for Abou-Chaker had signaled during the trial about the apartments that the acquittal of their client regarding the violence allegations from Bushido should also play a role in the assessment in the civil proceedings. In their opinion, there was no solid reason to exclude Arafat Abou-Chaker from the joint company. He had accused Bushido of lying in court.
After the separation in the musical business and the falling out, the two tried to wind down the real estate business quietly. But then, according to Abou-Chaker's brother, the "war of accusations" began. The family had been torn apart in court for four years. Bushido had lied and had granted power of attorney to Arafat as representatives of the real estate businesses.
