A 73-year-old father and his 51-year-old stepmother have been cleared of a negligent homicide charge connected to the death of their 41-year-old daughter. The Landgericht Landau in der Pfalz made this announcement on Monday. The court stated that the defendants could not have foreseen their daughter's fate or even deemed it possible.
The pair from Vollmersweiler (Kreis Germersheim) were accused of negligent homicide through omission. They were alleged to have failed to provide their ailing and physically fragile daughter with adequate care between December 2021 and February 2022, leading to her death due to depletion and illness. The father was also accused of tying his daughter to her bed multiple times. However, the court stated that it could not be conclusively determined if he had done this to protect her from self-harm. Furthermore, the daughter had persistently refused medical assistance, which could have prevented her from deteriorating.
During the trial, an expert witness testified that the deceased daughter was severely malnourished and emaciated. An autopsy revealed that she had a deep vein thrombosis in her thigh, a pulmonary embolism, a purulent bronchitis, and dehydration. The woman weighed approximately 45 kilograms upon her passing, with a height of approximately 1.60 meters. "An alternative doctor might have been able to help the day before, and possibly even on the day of death," the expert commented.
The prosecutor's office accused the couple of negligent homicide since they were aware of their daughter's dangerous condition but did not provide her with proper care. The prosecution suspected that there existed "psychological abnormalities" several months before the woman's death, speculating that she may have refused all medical aid.
"The elucidation of the facts in this case was complex and peculiar due to the fact that the offenses occurred within the family circle," the court explained. Individuals who could have aided in the investigation remained silent during the trial and exercised their right to remain silent. The verdict is not yet legally binding.
