- Court case concerning the cutting of the bike path
A property owner from the district of Coesfeld and the state of North Rhine-Westphalia will appear before the Administrative Court of Münster on Thursday (11:00 AM). The dispute revolves around high costs for pruning branches and shrubs that overhang onto a cycle path from the plaintiff's property.
The state-owned Straßen NRW had instructed the man to trim a hedge on his property in August 2022. After he failed to do so, the state hired a landscaping company in November 2022 and sent the plaintiff an invoice for €2,762.66.
However, the man refuses to pay this amount. He has taken the matter to the Administrative Court. His argument is that in the past, the state-owned company had always trimmed the hedge for free. Whether the court will announce a decision on Thursday after the oral hearing remains to be seen.
The man has expressed his intention to escalate the dispute to the higher Instance, specifically the Court of Justice, seeking a review of the Administrative Court's decision. In such a scenario, the final ruling on the cost dispute between the property owner and the state-owned Straßen NRW could potentially be made by the Court of Justice.
