To be eligible for payment, the divorced couple must have joint children, the marriage must have ended after June 30, 1977, and the surviving partner must not have remarried. Since the Orphan's Pension is paid from the insured person's own pension, the survivor must have also paid contributions to the statutory pension insurance for at least five years following the spouse's death.

The Orphan's Pension is applied for with the competent pension insurance carrier. The entitlement lasts until the child turns 18. If survivors have additional income, the Orphan's Pension may be reduced under certain circumstances.

The deductible amount for own income is currently €1,038 per month, and an additional €220 is added for each orphan's pension-eligible child. If income exceeds the deductible amount, 40% of the difference is deducted from the Orphan's Pension, and the payment is reduced accordingly, according to the DRV.
