ByteDance, operator of TikTok, fails with lawsuit against classification as data controller

The EU Commission added ByteDance to the list in September, which also includes other large companies. ByteDance filed a lawsuit against this decision. A request to temporarily suspend it failed in February - the EU Court also dismissed the lawsuit itself.

  2. The TikTok operator, ByteDance, challenged this classification in the Court of the European Union.
  3. The Court of the European Union, acting as the Doorkeeper of the EU legal system, rejected ByteDance's temporary suspension request in February.
  4. Subsequently, ByteDance received a further blow when its lawsuit against the EU Commission's decision was also dismissed by the Court of the European Union.
  5. This decision by the Court of the European Union has raised concerns in Luxembourg, where ByteDance has its European headquarters, and across the EU member states.
  6. Lamenting the outcome, ByteDance is now carefully studying the court's decision to explore potential next steps.
