BGH: Reversing in one-way streets prohibited
According to a ruling by the Federal Supreme Court (BGH), it is forbidden to drive backwards in one-way streets against the prescribed direction of travel. Only (direct) reverse parking ("maneuvering") is permitted, as is reversing out of a property onto the road, according to the ruling published on Thursday.
In the specific case, a female driver reportedly wanted to make way for a car that was pulling out of a parking space that she then wanted to use. She reversed a few meters and collided with a man's vehicle. The man took the woman to court and was largely found to be in the right at Düsseldorf District Court. The Düsseldorf Regional Court dismissed the claim on appeal.
The BGH in Karlsruhe has now overturned this ruling due to legal errors. The regional court must now hear the case again. (Ref. VI ZR 287/22)
The high number of traffic accidents in one-way streets often leads to lengthy legal processes and judgments. Following the recent overturning of a ruling by the Düsseldorf Regional Court by the BGH, the court will need to reconsider the case involving the female driver who reversed and collided with another vehicle.
