At home and on the move: where is nudity allowed?

For some, nudity is the embodiment of freedom, while others would never want to be naked in public. To avoid conflicts, it is important to know where one can be textile-free and where not.

When temperatures soar, many people reach for lighter clothing. For those it doesn't provide enough cooling, they might let go of their textiles altogether. What is acceptable in one place might be a problem elsewhere. Lawyer Swen Walentowski, spokesperson for the legal portal "anwaltauskunft.de," clarifies where nudity is allowed.

At home, in your own garden, on the balcony

"Within your own four walls and in your private garden or on the terrace, nudity is generally permitted," says Walentowski. However, this only applies if the areas are not visible to others and do not disturb neighbors. Otherwise, fines between 5 and 1000 Euro for disturbance may apply. Anyone who becomes sexually active in the garden or on the terrace may disturb the peace and must reckon with a warning or eviction.

In the city or in nature

Nudity outside of your own property is only allowed at explicitly designated places such as FKK beaches. As long as other bathers are not disturbed, the free body culture can also be acceptable at the lake or the sea. Nudist hiking in secluded forests or nudist jogging on country roads are seldom associated with negative consequences according to Attorney Walentowski.

Different rules apply if someone runs naked through a shopping center or sunbathes naked in a city park. Then, a warning or even a ban from the premises may be issued.

In the swimming pool at the public bath

Swimming pool guests must adhere to the house rules in the public bath, a corresponding dress code may apply. However: In Berlin baths, women have been allowed to sunbathe topless since a woman successfully fought against the unequal treatment of men and women in this regard through legal action. Some other cities have also issued similar regulations.

Naked car driving

Driving naked in a car is not generally prohibited, says Swen Walentowski. As long as drivers are able to safely operate the vehicle, they will not be held liable for damages in the event of an accident. However, getting out of the car may cause a disturbance, resulting in a fine for the infringement.

Where the limit to a crime is crossed

Anyone who exposes themselves in public to gain a sexual thrill, crosses the line into exhibitionism. "In this case, [...] a fine or imprisonment up to one year must be reckoned with," so Walentowski. However, this only applies to men. Women cannot be legally punished in this context.
