Revamping a Method - Appeal filed in case of elderly person's homicide and sexual assault.
A 61-year-old man convicted of raping and murdering a 69-year-old pensioner on a bike path in Neunkirchen-Sinnerthal will not have his verdict stand. Defense and prosecution have both submitted appeals, confirmed a spokesperson for the Saarbrücken District Court. The case will now be handled by the Federal Court of Justice in Leipzig.
The man, a German national, was sentenced to 15 years in prison last week for murder in conjunction with rape with fatal consequences. The court believed that the man had difficulty controlling his actions. In addition, he was ordered to be taken to a psychiatric hospital. The prosecution sought a life sentence and placement in a forensic institution.
The prosecution argued the man took part in sexual activities to satisfy his desires. He is a repeat sex offender who has been free since 2020 after a positive social prognosis. He has been in court since mid-March. The judge mentioned that the man has spent almost 33 years of his life in prison.
The court also upheld the prosecution's accusations of sexual harassment in six cases and bodily harm in conjunction with threats.
However, the defense saw it differently, considering only the conditions for rape with fatal consequences. They pleaded for a combined sentence of 12 years and placement in a psychiatric hospital.
