Processes - Appeal against sentences for rape in the city park
Several defendants have appealed against the verdicts for the rape of a 15-year-old girl in Hamburg's Stadtpark. A court spokesperson was initially unable to say on Wednesday how many of the nine convicted had lodged appeals. The Federal Court of Justice must decide on an appeal.
A juvenile chamber at the regional court sentenced nine defendants to prison on November 28. A tenth defendant was acquitted, as was an original eleventh defendant last April 5. The chamber suspended the juvenile sentences of one to two years for eight defendants on probation or so-called pre-parole - this means that a decision on probation will not be made for another six months. Only one 19-year-old received a harsher sentence of two years and nine months in prison without parole.
The court was convinced that the convicts, aged between 19 and 23, had raped a 15-year-old girl in September 2020. In doing so, they had taken advantage of the fact that the teenager showed considerable alcohol-related symptoms of intoxication after attending a party. The trial lasted over a year and a half and, apart from parts of the verdict, took place in camera.
NDR 90.3 had initially reported on the appeals.
