Parliament - AfD motion to vote on budget emergency unsuccessful
The AfD cannot prevent the planned discussion and declaration of a new budget emergency for 2024 in the Brandenburg state parliament next week. The urgent application to the Constitutional Court of the state of Brandenburg was rejected, the court announced on Friday evening.
"After a summary examination, the Constitutional Court did not see any overriding interests of the applicants that would urgently require the issuance of a temporary injunction," it said in a statement.
According to the AfD parliamentary group, the court should prohibit a hearing and a recommendation for a resolution in the Budget Committee on the declaration of emergency before the end of the year. A resolution should have been passed in the state parliament at the end of January at the earliest.
"We do not accept that the state parliament should declare an emergency in a rush job and disregard parliamentary consultation rights and duties in the process," said AfD parliamentary group leader Hans-Christoph Berndt before the court ruling on Friday evening.
He had pointed out that the Federal Constitutional Court had also prohibited the Federal Government from passing a resolution on the Building Energy Act before the summer break due to a lack of time for deliberations. "What is unconstitutional in Berlin is also unconstitutional in Potsdam," said Berndt.

- Despite the AfD's objection, the Constitutional Court of Brandenburg refused to issue a temporary injunction on the AfD's application, allowing the state parliament to proceed with the discussion and declaration of a new budget emergency for 2024.
