Adoption of the Citizens' Energy Act not halted

Court of law - Adoption of the Citizens' Energy Act not halted

For the time being, the FDP was unable to stop the adoption of the Citizens' Energy Act planned for Friday in court. The urgent application to the NRW Constitutional Court was rejected, the court announced on Thursday evening. The reasons were not yet available.

However, a further decision is still pending. According to the Constitutional Court in Münster, the applicant has combined his urgent application with an application for an interpretation of the state constitution regarding the scope of his rights and duties as a member of parliament.

The Citizens' Energy Act should make it possible for residents and local authorities to benefit financially from new wind turbines in their area. According to the court, an application by FDP MP Henning Höne against the state parliament's schedules was received on Wednesday evening.

According to the FDP parliamentary group leader's argument, he felt that his rights as a parliamentarian to a proper legislative procedure had been violated because, in Höne's view, the government parliamentary groups had tabled an amendment that was too extensive at too short notice. He had therefore demanded that the procedure no longer be continued in this last session week of the year.

According to the plans, the law was to be passed on Wednesday of this week. In protest against a twelve-page amendment tabled at short notice by the government parliamentary groups, the SPD and FDP pushed through a third reading. This was then scheduled for Friday.

Adoption with the black-green government majority should be certain. The state government wants the law to come into force on January 1, 2024 and only applies to new wind turbines.
