Action against judgment due to false mask certificates

Following the conviction of a doctor for false mask certificates and a suspended sentence, the public prosecutor's office does not want to accept the verdict. The prosecution has lodged an appeal, reported Thomas Kirschner, spokesman for the Landsberg district court, on Friday. Whether the defense will also file an appeal was initially unclear. The deadline for appealing against the verdict had not yet expired.

The 60-year-old doctor is accused of issuing a series of mask exemption certificates during the corona period without having examined the patients. Two practice employees are said to have filled out the blank certificates issued by the doctor practising in Kaufering in Upper Bavaria and forwarded them to recipients throughout Germany. The doctor became known throughout Germany during the pandemic due to his negative attitude towards government regulations.

He was ultimately sentenced to one year and nine months in prison in Landsberg am Lech at first instance for issuing incorrect health certificates in 112 cases. The sentence was suspended on probation.

The public prosecutor's office had demanded a three-year prison sentence for the man. Investigators assume that he distributed mask releases on a much larger scale. The public prosecutor's office assumes a total of more than 4,000 false certificates, but only listed some of them in the indictment. The defense lawyer, on the other hand, had demanded an acquittal for the accused, but at most a suspended sentence.

Despite the suspended sentence given to the doctor for issuing false mask certificates, the public prosecutor's office is concerned about the potential impact of unchecked processes on public health, especially during times of crisis like the Corona/Covid-19 pandemic. The concern over the spread of false health certificates, potentially reaching thousands, highlights the importance of maintaining integrity in such crucial processes related to public health and crime prevention.
