Absolutely no exemption granted for the face veil ban in Rhineland-Palatinate
The individual sought permission to don a alleged niqab while operating a vehicle, driven by their religious beliefs. This niqab conceals not only the hair, but also the entire face, leaving just the eyes visible. Regrettably, both the initial application and the subsequent appeal were denied by the LBM and the Administrative Court in Neustadt an der Weinstraße respectively.
Recently, the Higher Administrative Court declined an appeal against this verdict. The justification provided was that the facemask ban enhances overall road safety. Keeping a logbook, as suggested by the complainant as a condition, is not as effective in identifying drivers in automated traffic control systems. This condition applies exclusively to the vehicle, but the complainant might also operate other vehicles that do not have this condition.
Moreover, the court considers that the ban on facemasks does not significantly hinder anyone from practicing their faith. If she wishes to adhere to the dress code, the woman merely needs to abstain from driving. Her knee problems do not preclude her from utilizing public transportation. With her driver's license, she may drive a moped, for which the ban on facemasks does not apply due to the helmet requirement.
Despite operating other vehicles without the condition of keeping a logbook, the individual must comply with the facemask ban while driving due to the strict regulations. Other than driving, there are several ways the woman can adhere to her religious beliefs, such as covering her face in other public spaces.
