In Berlin-Friedrichshain, a truck driver was recently cleared in an appeal case of negligent homicide charged against him. This follows the death of a 37-year-old female cyclist that occurred three years ago when the driver's tractor-trailer hit and ran over her. The incident happened on Frankfurter Allee, where the woman swerved to avoid an illegally parked cash transporter.

The Regional Court justified their verdict last Thursday, stating that there was no evidence to suggest the truck driver should have anticipated the cyclist riding across the solid line. The decision upheld the ruling from the first trial, which took place at the District Court Tiergarten in September 2023. The judge in the first trial explained that there were insufficient indications to prove the driver could have avoided the accident. In addition, the bicyclist's liability was considered.

The prosecution had initially requested a fine of €1,200 (€15-a-day for 80 days) during the first trial. According to the prosecutor in the second trial, the overrunning could have been avoided if the driver had executed a complete braking maneuver. Attention should be paid to the cyclist's responsibility as well.

Incidentally, this collision occurred along a pop-up bike lane on May 27, 2021. There is a record of it available through a dashcam video. As seen in the footage, the woman made a turn without ensuing clear traffic. The driver was driving at a speed less than the speed limit of 50 kilometers per hour. The experts' opinion on the matter was that with a complete braking maneuver, it would have been impossible for the driver to prevent the overrunning but not the crash.

The woman, who worked as a translator and editor of a German-French comic magazine she developed, unfortunately passed away at the site of the accident. The driver testified with teary eyes in the initial trial, expressing regret for the outcome. Since the accident, he asserts he is unable to work. The verdict is not final as of yet.
