Homicide - 26-year-old killed in bunker: trial to be retried

The trial against a 31-year-old man who killed his ex-girlfriend in a bunker near Oranienburg is to be retried today at the regional court in Neuruppin. The Federal Court of Justice (BGH) had overturned the verdict of the district court for manslaughter and sentenced him to twelve and a half years in prison. The reason given by the BGH was a legally incorrect assessment of the evidence. According to this, "weighty circumstantial evidence" had not been taken into account which could indicate that murder could have been committed instead of manslaughter. For this to be the case, a murder criterion such as malice must be fulfilled.

According to last year's ruling by the Neuruppin Regional Court, the man from Oranienburg stabbed the then 26-year-old woman to death in the bunker in a forest near Oranienburg on July 15, 2021. He himself had told an expert witness that he had been in the bunker with his ex-girlfriend, but then had a "movie break" and subsequently found himself in front of the bunker with blood on his hands. The 26-year-old had been reported missing by family members a few days earlier. According to police investigations, the young woman had gone to the bunker voluntarily.
