- Defence goes to review after murder conviction for boy
Following the murder conviction of the Regional Court of Würzburg for a 15-year-old, the defense has lodged an appeal. The lawyers for the student had argued for a charge of manslaughter. However, the juvenile chamber found that the murder aggravating factor of premeditation was present, as the defendant had shot his 14-year-old victim in the head from behind. The act was planned, and the defendant had acted with direct intent. The court imposed a youth sentence of eight and a half years.
No appeal by the prosecution**
The prosecution has not lodged an appeal against the verdict of August 5, a spokesperson for the Regional Court said. Previously, media outlets had reported. If the defense also remains with the appeal after the written reasons for the judgment are available in a few weeks, the Federal Court of Justice will have to deal with the case.
The defense's decision to appeal the 15-year-old's conviction of murder is not contested by the prosecution. However, if the defense maintains their appeal after receiving the written reasons for the judgment, the Federal Court of Justice will need to evaluate the case.
