Judge halts Florida's prohibition on medical care for transgender teenagers.

A federal court has prevented Florida from enforcing a rule that prohibits healthcare for transgender youths, labeling it "unconstitutional."

Judge halts Florida's prohibition on medical care for transgender teenagers.

"Judge Robert Hinkle's recent statement asserted that gender identity is indeed genuine. He further added that Florida's law banning treatments for transgender youth and limiting them for adults violates their right to equal protection. The 2023 law, enacted by the Republican-led Florida legislature, and signed into law by Gov. Ron DeSantis, forbids doctors and nurses from prescribing medications such as hormones or puberty blockers to individuals under 18. Hinkle's opinion states that 'the State of Florida has the right to regulate, but cannot completely stop transgender people from receiving safe and effective medical care.'

The transgender petitioners, along with their parents, claimed this law infringed on their constitutional rights. In an extensive 105-page document, Judge Hinkle concurred, asserting that ‘denying or making it difficult for a person to align with their gender identity instead of their birth sex is not a valid state interest.'

The legal decision does not discuss the state law's prohibition on gender affirming surgeries for minors or restrictions for adults. Hinkle mentioned that these disputes were not contested in the lawsuit.

Simone Chriss, Transgender Rights Initiative Director at the non-profit Southern Legal Counsel law firm, celebrated this as a major victory for Florida. 'Federal court saw Florida's ban on the healthcare of transgender minors and the restrictions for adults as unconstitutional measures that couldn't stand up to judicial scrutiny,' she remarked. 'Today's ruling prevents the state of Florida from depriving its transgender citizens of their fundamental rights and basic healthcare.'

Following the order, the DeSantis office announced their intention to appeal the decision. 'The residents of Florida used their elected representatives to safeguard the children in the state, and the Court erred by overruling their will,' the statement read. 'The Court's rulings, at the expense of science and quality evidence, are incorrect. The injuries caused by these procedures are long-lasting and irreversible, much like historical responses to harmful societal fads.'"
