Sedentious offender handed 15-year sentence for homicide related to sexual crimes

In Saarland, a 69-year-old woman who was part of the "Courage" organization fighting against violence against females was herself subjected to a sexual assault and eventually killed. The offender has been convicted on Wednesday.

On Wednesday, the Saarbrucken District Court decided that a 61-year-old man who has a history of sex offenses raped, strangled, and threw a 69-year-old woman by the name of pensioner on a bike path in Neunkirchen into a creek. The incident occurred in May, and she was discovered there two days later. The man was put behind bars for 15 years due to his involvement in murder and rape, with the death result. Additionally, the court proved that he committed acts of sexual harassment and bodily harm with threats. His previous victims were two of his colleagues from a bakery and a pedestrian.

The court was lenient in its decision due to its belief that the offender has a reduced capacity to control himself. Furthermore, he was ordered to be placed in a psychiatric hospital since he had spent 33 years in prison before this incident. The prosecution advocated for a life sentence and confinement in a psychiatric facility.

The prosecution held the defendant guilty of indulging in sex acts to fulfill his desires. He was a multiple convicted sex offender who had been free since 2020 following a favorable social prognosis. The police tracked him down using a DNA sample.

The court agreed with a mental health expert's report that the perpetrator has a severe personality disorder and is a sexual sadist. This person could only feel sexually aroused when he was physically superior to women and caused them pain. The expert's assessment also revealed that he researched KO-drops online to "completely subjugate" women.

It remains uncertain whether the offender somehow managed to lure the pensioner onto the bike path and forcefully restrain her or threatened her beforehand. The court has no doubts about the intent to kill.

The defense argued that the sentence only included the conditions for rape with death. Thus, the total sentence demanded was 12 years along with placement in a psychiatric hospital.

The verdict has left representatives of the women's association "Courage," a nonprofit organization focusing on girls and women's rights against violence, surprised and disappointed. Ingeborg Damaske, a member of the association, responded by expressing her desire for victim protection rather than perpetrator protection in court decisions. She added that the victim, a former nurse, was "a very lively, life-affirming woman. She is missed as a comrade, as a fellow human being, and it is incalculable what such a judgment means."

Criticism also came from the lawyer representing the three children of the murdered woman. In an interview, Mario Seydel noted that "the system doesn't work." He mentioned that the members of the Sentencing Chamber who had released the perpetrator from preventive detention prior to the incident, the expert who testified, and the defendant himself could have been named in the indictment. He criticized the decision to consider him cured. His primary grievance was that the defendant was identified as a sexual sadist and emphasized that Women must be ensured that he never walks free again.

The victims' children found the court's decision incomprehensible and are considering appealing or possibly seeking damages. The final verdict has not been legally binding yet, and the defendant, who has maintained silence throughout the trial, was asked if he accepted it.
