In civil proceedings against a convicted double murderer for damages, a decision by the Higher Regional Court (OLG) is expected this Wednesday (10.00 a.m.). This could involve the examination of possible new evidence relating to the murders. The family and lawyers of Andreas Darsow from Babenhausen in southern Hesse, who was convicted in a criminal trial in 2011, are hoping for starting points for a retrial.

The Higher Regional Court is hearing the case at second instance in Darmstadt. In the first instance, a new taking of evidence was rejected and Darsow was sentenced to pay the almost 70,000 euros demanded by the state of Hesse. This is a payment made for the daughter who survived the crime.

For more than ten years, the wife and the now 54-year-old convict, who maintains his innocence, have been fighting to have the criminal proceedings reopened. However, strict rules apply to this.

In its 2011 verdict, the Darmstadt Regional Court considered it proven that the German man ambushed his neighbor in April 2009 after a long-standing dispute over noise pollution and shot him dead. According to the verdict, he then went into the house and shot the sleeping wife in the head with two bullets. He also shot the disabled daughter, who survived seriously injured.
